By creating an account or using Mentioned NZ (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding agreement between you and Mentioned NZ (“we”, “us”, “our”), a business operating in New Zealand.
Mentioned NZ monitors New Zealand news sources for keywords you specify and delivers alerts by email. We make reasonable efforts to provide timely and accurate coverage but do not guarantee that all relevant articles will be detected or that alerts will be delivered within any particular timeframe. News monitoring is inherently dependent on the availability and content of third-party RSS feeds which are outside our control.
New accounts receive a 30-day free trial with access to all features within the trial keyword limit. No credit card is required to start a trial. At the end of the trial period, the Service will continue in a limited read-only state until you subscribe to a paid plan.
Paid subscriptions are billed monthly in advance in New Zealand dollars (NZD) plus GST where applicable.
We offer a 30-day free trial so you can evaluate the Service before paying. Because of this, we do not offer refunds on subscription fees once a billing period has commenced.
Nothing in this clause limits any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If the Service has a significant fault that we cannot remedy within a reasonable time, you may be entitled to a refund regardless of this clause. We reserve the right to suspend or terminate accounts that breach these terms without refund.
The number of keywords you may monitor is determined by your subscription plan. Limits are enforced automatically. We may update plan limits with reasonable notice, provided existing subscribers are not disadvantaged during their current billing period.
The Mentioned NZ platform, including its design, software, and branding, is owned by us. Article content surfaced through the Service remains the property of the original publishers. Your keywords and account data remain yours.
To the maximum extent permitted by law, Mentioned NZ is not liable for any indirect, incidental, or consequential loss arising from your use of the Service, including loss of business, missed media coverage, or decisions made based on alerts received.
Our total liability for any claim arising from use of the Service is limited to the amount you paid us in the 3 months preceding the claim.
We aim to keep the Service available but do not guarantee uninterrupted access. We may perform maintenance from time to time and will endeavour to minimise disruption. We are not liable for downtime caused by factors outside our control, including third-party infrastructure or RSS feed outages.
You may close your account at any time from the Settings page. We may suspend or terminate your account if you breach these terms, fail to pay, or if we decide to discontinue the Service. If we discontinue the Service, we will provide at least 30 days’ notice and refund any prepaid subscription fees for the unused portion of your billing period.
We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated terms. If you do not agree to the changes, you may cancel your subscription before they take effect.
These terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
